1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and East Coast Air LLC ("we," "us," or "our"), concerning your access to and use of the eastcoastairllc.com website as well as any related HVAC services, installations, repairs, or maintenance provided by us. By accessing the site or utilizing our services, you agree that you have read, understood, and agree to be bound by all of these Terms.

2. Services and Estimates

2.1. Scope of Work: We provide residential and commercial HVAC services in the South Shore, MA area. The specific scope of work will be detailed in a written estimate or service agreement provided to you prior to the commencement of any work.

2.2. Estimates: Estimates are valid for thirty (30) days from the date of issue unless otherwise specified. We reserve the right to revise estimates if unforeseen structural, electrical, or mechanical issues are discovered upon commencement of work.

2.3. Scheduling: While we strive to adhere strictly to scheduled appointment times, arrival windows are approximate due to the unpredictable nature of service calls and traffic.

3. Payment Terms

3.1. Invoicing: Payment is due upon completion of the service unless prior financing arrangements have been made. For large installations, a deposit may be required before equipment is ordered or work begins.

3.2. Late Payments: Accounts not paid within the agreed terms are subject to a late fee of 1.5% per month (18% annually) on the unpaid balance.

3.3. Financing: Any financing options provided are subject to third-party credit approval and their respective terms and conditions.

4. Warranties and Guarantees

4.1. Workmanship: We warrant that all labor performed by East Coast Air LLC will be done in a professional, workmanlike manner. We provide a limited warranty on our labor as specified in your individual service agreement.

4.2. Equipment: All equipment and materials installed are covered solely by the manufacturer's warranty. We will assist in processing warranty claims for equipment we have installed, provided the account is in good standing and the equipment has been properly maintained.

4.3. Exclusions: Warranties do not cover damage caused by acts of God, vandalism, improper use, unauthorized repairs by third parties, or failure to perform routine maintenance (e.g., changing filters).

5. Mass Save® and Rebate Programs

While we assist customers in navigating and applying for Mass Save® and other local or federal rebates, East Coast Air LLC does not guarantee the approval, amount, or timeline of any rebate. Rebate programs are administered by third parties and are subject to their own rules, funding availability, and eligibility requirements.

6. Limitation of Liability

To the fullest extent permitted by applicable law, East Coast Air LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with our services, equipment failure, or your use of our website. Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. Customer Responsibilities

You agree to provide safe and clear access to the work area, including ensuring that pets are secured and delicate items are removed from the vicinity of the HVAC equipment. You are responsible for obtaining any necessary homeowner association (HOA) approvals prior to installation.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Massachusetts.

9. Modifications to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. The updated version will be indicated by an updated "Last Updated" date. Your continued use of the site or our services after the date such revised Terms are posted constitutes your acceptance of the changes.
